This legal notice regulates the use of the www.motorlandaragon.com internet Portal service

The purpose of this document is to regulate the RULES OF USE and to safeguard THE PROTECTION OF USERS of www.motorlandaragon.com owned by CIUDAD DEL MOTOR DE ARAGÓN, S.A. (hereinafter CMA), of Ctra. TE-V 7033, km 1. Edificio de oficinas del circuito de velocidad 44600 (Alcañiz) Spain. The terms “You” and “User” will here be used to refer to all individuals and/or entities that for any reason might access this web Portal.

CMA, through www.motorlandaragon.com, aims to bring CMA to the users, and to make information related to our project available to them.

1. GENERAL CONDITIONS AND THEIR ACCEPTANCE.

These general conditions (hereinafter the "General Conditions") regulate the use of the "www.motorlandaragon.com " internet Portal service (hereinafter the "Portal") which CMA makes freely available to the internet users.

The use of the Portal attributes the condition of Portal user (hereinafter the "User") and expresses the full and reserve-free acceptance by the User of each and every one of the General Conditions in the version published by CMA at the time when the User accesses the Portal. As a consequence, the User must carefully read the General Conditions each time they decide to use the Portal.

The use of certain services offered to Users through the Portal is subject to their own special conditions, which shall at times replace, complete and/or modify the General Conditions (hereinafter the "Special Conditions").

Before the use of said services, therefore, Users must also carefully read the corresponding Special Conditions. The use of the Service is also subject to all warnings, regulations of use and instructions given to the User by CMA, which complete these General Conditions insofar as they are not opposed.

2. OBJECT.

Through the Portal, CMA provides Users with access to and the use of several services and contents made available to the Users by CMA or by third party users of the Portal and/or third party service and content providers (hereinafter the "Services").

CMA reserves the right to unilaterally modify the presentation and configuration of the Portal at any time and without forewarning, as well as the Services and the conditions required for the use of the Portal and the Services.

3. CONDITIONS OF ACCESS TO AND USE OF THE PORTAL.

3.1 Free nature of access to and use of the Portal

The Portal service is provided free to Users by CMA and requires no previous user subscription or registry. However, the use of some services may only be possible by user subscription and/or registry and/or the payment of a price, which will be expressly indicated in their corresponding Special Conditions.

3.2 Obligation on correct use of the Portal and the Services

The User agrees to use the Portal and the Services according to law, these General Conditions, and generally accepted good customs and public order. The User agrees to refrain from using the Portal and the Services for illicit purposes or effects contrary to these General Conditions and which might harm the rights and interests of others or which might in any way damage, render useless, overload or damage the Portal and the Services or prevent the Users’ normal use and enjoyment of the Portal and the Services.

3.3. Means for obtaining Content

The User shall refrain from obtaining and even trying to obtain information, messages, graphics, drawings, sound/image files, photographs, recordings, software and generally any kind of material accessible through the or the Services (hereinafter the "Content") by using means or procedures other than those provided to this effect or which have been indicated to this effect on the web pages containing the Content, or generally those habitually used to this effect on the internet or which do not cause a risk of damage or of rendering the Portal, the Services and/or the Content useless.

3.4. Correct use of the Content

Using the Content in such a way, for such purpose or to such effects that might be contrary to law, morale and generally accepted good customs or public order.

Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or altering the Content, without the authorisation of the holder of the corresponding rights or if this should be legally permitted.
Using content for defamatory, illicit or other purposes that might harm the image of CMA.
Suppressing, eluding or manipulating the copyright and other data identifying the rights of CMA or its holders in the Content, as well as all protective technical devices, digital fingerprints or any mechanisms of information that the Content might contain.

3.5. Insertion of hyperlinks allowing access to the web pages of the Portal and the Services

The Users and generally all people wishing to set up a hyperlink between their web page and the Portal (hereinafter the "Hyperlink") must meet the following conditions:

The Hyperlink will only give access to the web pages of the Portal, but may not reproduce them in any way.
No hyperlinks will be established with web pages of the Portal other than the home-page or the first page of the Portal or the Services.

No browser or border environment will be created on the web pages of the Portal.

No false, inaccurate or incorrect declarations or indications may be made on the web pages of the Portal and the Services and particularly no declaration or understanding may be made that CMA has authorised the Hyperlink or has in any way supervised or assumed the contents or services offered or made available on the web page on which the Hyperlink is established.

An exception to this is the signs that form part of the Hyperlink itself; the web page on which the Hyperlink is established will not contain any brand, trademark, establishment sign, name, logo, slogan or other distinctive signs belonging to CMA.

The web page on which the Hyperlink is established will not contain information or content that is illicit, contrary to morale and generally accepted good customs and public order, or contain contents contrary to any third-party rights.

The establishment of the Hyperlink in no case implies the existence of a relationship between CMA and the owner of the web page on which it is established, or the acceptance and approval by CMA of its contents or services.

4. PERSONAL DATA

In order to use some of the Services, the Users must previously provide CMA with certain personal data (hereinafter the "Personal Data"). CMA will perform automated treatment of the Personal Data for the purposes and under the conditions defined in its Data Protection Policy (PRIVACY POLICY).

5. RESPONSIBILITY FOR THE INSERTION OF PERSONAL DATA.

The Users assume that CMA will be relieved of all liability for the incorporation of personal data that are imprecise, false, not updated or which generally fail to conform to reality. Similarly, CMA will be relieved of liability for the declaration of real data by persons not associated with them.

6. USE OF THE PORTAL, THE SERVICES AND THE CONTENTS UNDER THE EXCLUSIVE RESPONSIBILITY OF THE USER

Users are aware and voluntarily accept that their use of the Portal, the Services and the Content occurs in all cases exclusively under their own responsibility.

7. EXCLUSION FROM GUARANTEES AND RESPONSIBILITY

7.1 Exclusion from guarantees and responsibility for the operation of the Portal and the Services

7.1.1 Availability and continuity, utility and fallibility
CMA accepts no liability for the availability and continuity of the operation of the Portal and the Services. Whenever it is reasonably possible, CMA will previously warn of all interruptions in the operation of the Portal and the Services. CMA does not guarantee the utility of the Portal and the Services for the performance of any activity in particular, nor for its infallibility and, particularly but not exclusively, that Users might effectively be able to use the Portal and the Services, to access the different web pages forming the Portal or those from which the Services are given.

CMA EXCLUDES ALL LIABILITY FOR DAMAGE AND HARM OF ANY KIND THAT MIGHT BE DUE TO LACK OF AVAILABILITY OR CONTINUITY IN THE OPERATION OF THE PORTAL AND THE SERVICES, ANY DISAPPOINTMENT IN USE THAT USERS MIGHT ATTRIBUTE TO THE PORTAL AND TO THE SERVICES, ANY FALLIBILITY IN THE PORTAL AND THE SERVICES, AND PARTICULARLY, THOUGH NOT EXCLUSIVELY, ALL FAULTS IN ACCESSING THE DIFFERENT WEB PAGES OF THE PORTAL OR THOSE FROM WHICH THE SERVICES ARE GIVEN.

7.1.2 Privacy and security in the use of the Portal and the Services
CMA does not guarantee privacy and security in using the Portal and the Services and especially does not guarantee that unauthorised third parties might not be aware of the nature, conditions, characteristics and circumstances of the use that the Users make of the Portal and of the Services. CMA EXCLUDES ALL LIABILITY FOR DAMAGE AND HARM OF ALL KINDS THAT MIGHT BE DUE TO UNAUTHORISED THIRD-PARTY KNOWLEDGE FOR THE NATURE, CONDITIONS, CHARACTERISTICS AND CIRCUMSTANCES OF THE USE THAT USERS MAKE OF THE PORTAL AND OF THE SERVICES.

7.2 Exclusion from guarantees and responsibility for the Content

7.2.1 Quality
CMA neither controls nor guarantees the absence of viruses or other elements in the Content which might cause alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system. CMA WAIVES ALL LIABILITY FOR DAMAGE AND HARM OF ANY NATURE THAT MIGHT BE DUE TO THE PRESENCE OF VIRUSES OR OTHER ELEMENTS IN THE CONTENT THAT MIGHT CAUSE ALTERATIONS IN USERS’ COMPUTER SYSTEMS, ELECTRONIC DOCUMENTS OR FILES.

7.2.2 Licit nature, reliability and utility
CMA does not guarantee the licit nature, the reliability and usefulness of the Content. CMA, WAIVES ALL LIABILITY FOR DAMAGE OR HARM OF ANY NATURE THAT MIGHT BE CAUSED BY THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTENTION OF OR ACCESS TO CONTENT, AND PARTICULARLY, THOUGH NOT EXCLUSIVELY, FOR DAMAGE OR HARM THAT MIGHT BE CAUSED: BY BREACH OF THE LAW, MORALE AND GENERALLY ACCEPTED GOOD CUSTOMS AND PUBLIC ORDER AS A CONSEQUENCE OF THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTENTION OF OR ACCESS TO CONTENT; BY BREACH OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS, BUSINESS SECRETS, CONTRACTUAL COMMITMENTS OF ANY KIND, RIGHTS OF HONOUR, PERSONAL AND FAMILY PRIVACY AND THE IMAGE OF PEOPLE, PROPERTY RIGHTS AND RIGHTS OF ANY OTHER NATURE BELONGING TO THIRD PARTIES AS A CONSEQUENCE OF THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTENTION OF OR ACCESS TO CONTENT; THE PERFORMANCE OF ACTS OF DISLOYAL COMPETITION AND ILLICIT ADVERTISING AS A CONSEQUENCE OF THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTENTION OF OR ACCESS TO CONTENT; THE LACK OF TRUTHFULNESS, EXACTITUDE, EXHAUSTIVENESS, BELONGING AND/OR UPDATING OF THE CONTENT; INAPPROPRIATENESS FOR ANY KIND OF PURPOSE AND THE DISAPPOINTMENT OF THE EXPECTATIONS GENERATED BY THE CONTENT; BREACH, DELAY AND FULFILMENT, DEFECTIVE FULFILMENT OR TERMINATION FOR ANY CAUSE OF THE OBLIGATIONS CONTRACTED BY THIRD PARTIES AND CONTRACTS MADE WITH THIRD PARTIES THROUGH OR UPON ACCESS TO CONTENT; ALL VICES AND FAULTS OF ALL KINDS IN CONTENT WHICH IS TRANSMITTED, DISSEMINATED, STORED, MADE AVAILABLE OR OTHERWISE TRANSMITTED OR MADE AVAILABLE, RECEIVED, OBTAINED OR ACCESSED THROUGH THE PORTAL OR THE SERVICES.

7.2.3 Truthfulness, exactitude, exhaustiveness and updating

CMA does not guarantee the truthfulness, exactitude, exhaustiveness or currency of the Content. CMA WAIVES All RESPONSIBILITY FOR DAMAGE OR HARM OF ANY KIND THAT MIGHT BE DUE TO LACK OF TRUTHFULNESS, EXACTITUDE, EXHAUSTIVENESS AND/OR CURRENCY OF THE CONTENT.

7.3 Exclusion from guarantees and responsibility for the services given by third parties through the Portal

7.3.1 Quality

CMA, WAIVES ALL LIABILITY FOR DAMAGE OR HARM OF ANY NATURE THAT MIGHT BE CAUSED BY THE SERVICES GIVEN BY THIRD PARTIES THROUGH THE PORTAL, AND PARTICULARLY, THOUGH NOT EXCLUSIVELY, FOR DAMAGE OR HARM THAT MIGHT BE CAUSED: BY BREACH OF THE LAW, MORALE AND GENERALLY ACCEPTED GOOD CUSTOMS AND PUBLIC ORDER AS A CONSEQUENCE OF THE PERFORMANCE OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL; BY BREACH OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS, BUSINESS SECRETS, CONTRACTUAL COMMITMENTS OF ANY KIND, RIGHTS OF HONOUR, PERSONAL AND FAMILY PRIVACY AND THE IMAGE OF PEOPLE, PROPERTY RIGHTS AND RIGHTS OF ANY OTHER NATURE BELONGING TO THIRD PARTIES AS A CONSEQUENCE OF SERVICES GIVEN BY THIRD PARTIES THROUGH THE PORTAL; THE PERFORMANCE OF ACTS OF DISLOYAL COMPETITION AND ILLICIT ADVERTISING AS A CONSEQUENCE OF SERVICES GIVEN BY THIRD PARTIES THROUGH THE PORTAL; THE LACK OF TRUTHFULNESS, EXACTITUDE, EXHAUSTIVENESS, BELONGING AND/OR UPDATING OF THE CONTENT TRANSMITTED, DISSEMINATED, STORED, RECEIVED, OBTAINED, MADE AVAILABLE OR ACCESSIBLE BY MEANS OF THE SERVICES GIVEN BY THIRD PARTIES THROUGH THE PORTAL; INAPPROPRIATENESS FOR ANY KIND OF PURPOSE AND THE DISAPPOINTMENT OF THE EXPECTATIONS GENERATED BY THE CONTENT GENERATED BY SERVICES GIVEN BY THIRD PARTIES THROUGH THE PORTAL; BREACH, DELAY AND FULFILMENT, DEFECTIVE FULFILMENT OR TERMINATION FOR ANY CAUSE OF THE OBLIGATIONS CONTRACTED BY THIRD PARTIES AND CONTRACTS IN RELATION TO OR BY REASON OF SERVICES GIVEN BY THIRD PARTIES THROUGH THE PORTAL; ALL VICES AND FAULTS OF ALL KINDS IN SERVICES GIVEN BY THIRD PARTIES THROUGH THE PORTAL.

7.4 Exclusion from guarantees and responsibility for information, content and services housed outside the Portal.
The Portal provides the Users with technical means for linking (such as links, banners, buttons, and others), directories and search tools that allow the Users to access websites belonging to and/or managed by others (hereinafter "Linked Sites"). The installation of said links, directories and search tools in the Portal is solely intended to help the Users seek and access the information, contents and services available on the internet. CMA does not offer or commercialise the information, content and services available in the Linked Sites through itself or any other third party, nor controls them, approves them, monitors them or makes them their own. The User shall therefore take care in assessing and using the information, content and services in the Linked Sites.

CMA, NEITHER GUARANTEES NOR TAKES ANY RESPONSIBILITY FOR DAMAGE AND HARM OF ANY KIND THAT MIGHT BE CAUSED BY: THE OPERATION, AVAILABILITY, ACCESSIBILITY OR CONTINUITY OF THE LINKED SITES; THE MAINTENANCE OF THE INFORMATION, CONTENT AND SERVICES IN THE LINKED SITES; THE PROVISION OR TRANSMISSION OF THE INFORMATION, CONTENT AND SERVICES IN THE LINKED SITES; THE QUALITY, LICIT NATURE, RELIABILITY AND USEFULNESS OF THE INFORMATION, CONTENT AND SERVICES IN THE LINKED SITES, IN THE SAME TERMS AND WITH THE SAME SCOPE AS SET OUT IN THE GENERAL CONDITION.

7.5 Exclusion from guarantees and responsibility for the use of the Portal, the Services and the Content by the Users
CMA is under no obligation to monitor and does not monitor the use that the Users make of the Portal, the Services and the Content. In particular, it does not guarantee that the Users use the Portal, the Services and the Content in full accordance with these General Conditions and any Special Conditions that might apply, nor that they do so with diligence and caution.

CMA neither has the obligation to monitor, nor monitors, the identity of the Users or the truthfulness, currency, exhaustiveness and/or authenticity of the data that Users supply about themselves to other Users. CMA WAIVES ALL LIABILITY FOR DAMAGE OR HARM OF ANY KIND THAT MIGHT BE DUE TO THE USE OF THE SERVICES AND CONTENT BY THE USERS OR DUE TO THE LACK OF TRUTHFULNESS, CURRENCY, EXHAUSTIVENESS AND/OR AUTHENTICITY OF THE INFORMATION THAT THE USERS GIVE OTHER USERS ABOUT THEMSELVES, AND ESPECIALLY BUT NOT EXCLUSIVELY, FOR DAMAGE AND HARM OF ANY NATURE THAT MIGHT BE DUE TO THE REPLACEMENT OF THE PERSONALITY OF A THIRD PARTY BY A USER IN ANY KIND OF COMMUNICATION MADE THROUGH THE PORTAL.

8. NON-LICENCE

CMA grants no licence or authorisation of use of any kind on their industrial and intellectual property rights or on any other property or right related to the Portal, the Services or the Content.

9. REFUSAL AND WITHDRAWAL OF ACCESS TO THE PORTAL AND/OR THE SERVICES

CMA reserves the right to refuse or withdraw access to the Portal and/or the Services at any time and without any need for forewarning to Users in breach of these General Conditions or any Special Conditions that might be applicable.

10. PROCEDURE IN THE CASE OF PERFORMANCE OF ILLICIT ACTIVITIES.

If any User or third party should believe there are facts or circumstances that reveal the illicit nature of the use of any content and/or the performance of any activity on the web pages included in or accessible via the Portal, and especially breach of intellectual or industrial property rights (patents, models and industrial drawings, brands and trademarks, etc.) or other rights, they must send a notification to CMA containing the following:

Personal data: name, address, telephone number and electronic mail address of the claimant.
Specification of the supposed illicit activity performed in the Portal and, particularly when it is a supposed breach of rights, and precise and specific indication of the protected contents and their location in the web pages.

Facts or circumstances revealing the illicit nature of said activity.

In the case of breach of rights, authentic signature or equivalent with the personal details of the holder of the supposedly breached rights or the person authorised to act on their behalf.

Express and clear declaration under the responsibility of the claimant that the information provided in the notification is accurate and of the illicit nature of the use of the contents or the performance of the described activities.

11. DURATION AND TERMINATION

The performance of the Portal and other Services in principle is indefinite in duration. However, CMA is authorised to terminate or suspend the provision of the Portal and/or any of the Services at any time, notwithstanding anything provided in this respect in the corresponding Special Conditions. Whenever it is reasonably possible, CMA will previously notify the termination or suspension of the provision of the Portal and other Services.

12. APPLICABLE LAW AND JURISDICTION

These General Conditions and Rules of Use are governed by Spanish Law. In resolving any controversy that might arise with respect to their validity, performance, fulfilment or resolution (total or partial) the parties submit to the competence of the Courts of Alcañiz. This contract is the complete and comprehensive expression of the agreement between CMA and the user.

Users are so by the mere fact of using the Portal; such use implies full acceptance without reservations of each and every one of the provisions of this Legal Notice.
